Terms of Service

These Terms of Service (“Terms”) govern your use of SmithTag (“SmithTag”, “we”, or “us”). By creating an account or using the service, you agree to these Terms. If you do not agree, please do not use SmithTag.

1. The service

SmithTag uses artificial intelligence to help you create product listings — including titles, descriptions, tags, and selling points — from a photo you upload, plus optional AI photo restyling. The output is generated automatically and may contain errors or inaccuracies. You are responsible for reviewing and editing everything before you publish or rely on it.

2. Your account

You must provide a valid email address and keep your account secure. You are responsible for activity that happens under your account. You must be at least 16 years old to use SmithTag.

3. Credits and payments

SmithTag runs on credits. New accounts receive a limited number of free trial credits, and you may purchase additional credits. One credit is used each time you generate a listing. Prices and credit amounts may change over time. Except where required by law, purchased credits are non-refundable. Payments are handled by our payment provider, and you agree to their terms as well.

4. Acceptable use

When using SmithTag, you agree not to:

• Upload content you do not own or have the right to use;
• Upload unlawful, infringing, harmful, or offensive content;
• Attempt to disrupt, overload, reverse engineer, or gain unauthorized access to the service;
• Resell or redistribute the service itself without our permission.

5. Content and ownership

You keep all rights to the photos you upload and the listings SmithTag generates for you, and you are free to use that generated content in your own shops and stores. You grant us the limited permission needed to process your photos and provide the service. The SmithTag name, brand, and software remain our property.

6. Not affiliated with Etsy

SmithTag is an independent tool and is not affiliated with, endorsed by, or sponsored by Etsy, Inc. Etsy is a trademark of its respective owner. You are responsible for following the policies of any marketplace where you publish your listings.

7. Disclaimers

SmithTag is provided “as is” and “as available,” without warranties of any kind. We do not guarantee that generated listings will be accurate, rank in search, comply with any marketplace’s rules, or increase your sales. You use the output at your own discretion and risk.

8. Limitation of liability

To the fullest extent permitted by law, SmithTag will not be liable for any indirect, incidental, or consequential damages, or for lost profits or sales, arising from your use of the service. Our total liability for any claim will not exceed the amount you paid us in the three months before the claim.

9. Termination

You may stop using SmithTag at any time. We may suspend or terminate accounts that violate these Terms or misuse the service.

10. Changes to these Terms

We may update these Terms from time to time. Continued use of SmithTag after changes take effect means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules.
